Elements of Harbors and Navigation Code 655(c)
The District Attorney must prove that the
- Defendant operated a vessel, water skis, an aquaplane, or similar device and
- The defendant had a blood alcohol content of .08% or more.

Many of the same defensed applicable to DUI are applicable to Boating under the influence.
Consequences of a Boating Under the Influence
The DMV does not suspend your license for a boating under the influence. You may be subject to a fine and jail time, but in no event more than six months.
